MINUTES OF THE PUBLIC MEETING OF APRIL 13TH, 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Public Hearings

7:45 PM  Continued Abbreviated Notice of Resource Area Delineation for confirmation of the wetland line across from 670 Pleasant Street, Assessor’s Map 8, Lot 11-1 for Development South Realty Trust, 169 Summer St., Kingston, MA.  (DEP #175-423)

Al Vautrinot of Vautrinot Land Surveying presented revised plans that added White Oak Brook
as a riparian zone.  He also explained that a portion of an isolated wetland would eventually need to be filled to get a road in.  Ms. Cassady said that would require a future Notice of Intent filing.   Mr. Lindquist asked for comments from abutters.

Michael King, 681 Pleasant St. –  Mr. King commented that he thought the vernal pool was deeper than shown.  Ms. Cassady said that the soils were upland.  He also had a question about the 200-foot riparian zone.  Ms. Cassady explained that according to USGS maps, the project would be out of the R. zone.  Mr. King said that he has seen frogs that could be endangered in the area.  
Stephen Shangold, 631 Pleasant St. – Mr. Shangold had concerns with water coming into his yard and basement.  Mr. Shangold has also seen turtles out there and suggested an environmental impact study.  Also, concerns with filling.  Mr. Vautrinot said they would replicate any disturbance elsewhere on the property.
Pina D Sr., Pina Family Trust, 719 Pleasant St. –  wanted to know if they would have to file in the future for building.

8:00 PM  Notice of Intent (New Hearing) for a septic system repair at 1 Emory St., Assessor’s Map 2, Lot 50 for John Rothwell, owner, represented by Alan Dias, P.O. Box 314, Monponsett, MA  (DEP #175-422)

Craig Nicholson read the public hearing notice and the green cards were checked.  One abutter had not been notified.  Therefore, the hearing will be re-advertised with another certified mailing.

8:15 PM  Continued Abbreviated Notice of Intent for construction of four (4), two-bedroom, single family units and parking lot with twelve parking spaces, the rear only of parking lot (approx. 312 sq.ft) in the 100-foot buffer zone at Elm St., Assessor’s Map 36, Lots 8-1R & 8-2R for Donald Shute, 345 Washington St., Pembroke, owner. 8:30 PM  Request for Determination of Applicability for routine maintenance performed at the Thomas Mill Site, Liberty St., Assessor’s Map 81, Lot 8 for Donald Ellis, 742 High St., Hanson, MA

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Mr. Vautrinot presented a proposal for routine maintenance at the Mill site.  Lynne Hollis, 573 Liberty St. who is an abutter had concerns about tree-cutting.  Also, she doesn’t want another fence.  Ms. Cassady made note of a cherry tree that Ms. Hollis would like to stay.

8:45 PM Reconsideration of a Notice of Intent for construction of a single family house and septic system on West side of Union St., Assessor’s Map 31, Lot 7A & 6, for Elko Construction, Inc., P.O. Box 485, Hanson, MA  (DEP #175-369)

There was concern about three white cards missing.   Al Vautrinot will hand deliver notices to other abutters and under pain of perjury, continue with the hearing.  Mr. Vautrinot presented revised plans showing the septic outside the 50-foot no build zone.  It has Board of Health approval. They are asking for a variance as the house is 24’ x 36’ and is 42 feet from the Bordering

vegetated wetland.  However, the variance letter could not be located in the file.  Mr. Vautrinot will locate the letter and make a copy.   Mr. Lindquist asked for comments from abutters.
Phil Reilly, 11 Plymouth St. had a question about the location of the lot.
Jeffrey & Christina Heyl, 19 Plymouth St. attended but didn’t have questions.

Ms. Cassady suggested that a bond be posted for culpability of the variance request.

9:00 PM  Notice of Intent (New Hearing) for construction of a single family house and septic system on Holmes St., Assessor’s Map 57, Lot 7A for Mark Comeau, 5 Meadow Lane, Apt. 9, Bridgewater, MA  (DEP #175-424)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Mr. Comeau presented plans and a request for a variance.  (see attached) A small portion of the grading is in the 50-foot no disturb zone, about 10 square feet.  Ms. Gardner suggested a row of plantings along the BVW to distinguish the wetlands.

This hearing was previously heard on February 10, 2004 but was re-advertised and all abutters re-notified as it was found after the fact that the abutter’s list had not been certified and was not complete.

9:45 PM  Notice of Intent (New Hearing)  for construction of a 19,200 SF contractor’s building and yard with associated grading, driveway and detention basin as well as filling approx. 2,732 SF of wetlands with a replication of 4,198 SF as shown on the site plan at Industrial Blvd., Assessor’s Map 67, Lot 17-13, for West Hanover Strawberry Hill, LLC, 1401 Hanover St., Hanover, MA represented by Merrill Assoc., Inc., 427 Columbia Rd., Hanover, MA  (DEP#175- )

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Douglas Schroeder of Merrill Associates made a presentation.  Mr. Pongrantz, owner was also present.    Mr. Pongrantz explained that the building will be used for a contractor’s storage/office facility.
Ms. Cassady feels strongly that it is not necessary to fill the wetlands as is suggested in the plans and replicated elsewhere.   Ms. Cassady would like a copy of the resume of the botanist who delineated the wetlands, John P. Richardson in the file.  Additionally, the 50-foot buffer zone should be indicated on the submitted plans correctly.  A site visit was scheduled for Saturday, April 24th at 3 PM.

Orders of Conditions/Certificates of Compliance/Determination of Applicability

Negative Determination of Applicability for a septic repair at 23 Monroe St., Assessor’s Map 32, Lot 10,  for Robin and Stephen Curran represented by Al Vautrinot of Vautrinot Land Surveying, P.O. Box 144, Plympton, MA with conditions:  1.  Prior to the start of construction, a single row of double-
staked haybales shall be installed as shown on the approved plans.  Stakes shall be cut flush with the tops of the bales.  2.  Once the haybales are installed, a site inspection shall be scheduled with either the Conservation Agent or a
Commissioner.  Please call the office at 781-294-4119, Ext.118.  3.  The existing cesspool shall be pumped and crushed prior to the installation of the new system.  4.No work shall take place within the 50-foot no disturb zone.  5.  Any changes to the approved plan will require the applicant and their engineer to either request an amended Determination of Applicability or a new Request for Determination or Notice of Intent. 6.   Once the yard is re-vegetated and stable, the haybales can then be removed and disposed of properly. - SIGNED
